General Terms & Conditions Of Sale

www.sanabay.com (hereinafter referred to as “the site”) is published by SNB, a limited liability company with a capital of 22,200 euros, whose registered office is located at 104-112 avenue de la résistance, 93100, Montreuil, registered with the RCS of BOBIGNY under number 881 520 779, intra-community VAT number FR 36881520779 (hereinafter referred to as “SNB” or “SANABAY”). All orders placed on the www.sanabay.com website are subject to these general terms and conditions of sale. SNB reserves the right to adapt or modify these terms and conditions at any time, the version of the general terms and conditions of sale applicable to any transaction being the one appearing online on the www.sanabay.com website at the time of the order.

I- The Client

The Customer declares that he is a natural or legal person and has the legal capacity to place an order on the site. 

When registering the Customer’s personal data in the “my account” section, the Customer must ensure the accuracy and completeness of the mandatory data he provides. In the event of an error in the wording of the recipient’s details, SNB cannot be held responsible for the impossibility of delivering the product. The Company SNB reserves the right to cancel any order when the Client’s IP address is domiciled in a different country from the billing and/or delivery address.

II- Products

The SNB Company markets articles made by craftsmen. All articles are manufactured according to precise specifications, however, nuances in size, colour or shape may vary from one article to another. The products offered for sale are those described on the Site. SNB takes the greatest care in the presentation and description of these products in order to best satisfy the Client’s needs. However, it is possible that non-substantial errors may appear on the Site, which the Client acknowledges and accepts. The photographs and other visuals presented on the Site are non-contractual. They are for information purposes only and do not engage the responsibility of SNB. In any event, in the event of non-conformity of the product delivered in relation to its description on the Site, the Client may exercise his right of withdrawal or implement the legal guarantee of conformity. SNB will, where appropriate, refund all or part of the invoiced price upon receipt of the item at the return address provided by SNB.

III- The Order

Orders taken on the Site are subject to compliance with the procedure set up by SNB, which consists of a succession of different stages that the Client must follow in order to validate his order. Before definitively validating his order, the Client will have the opportunity to check the details of the order and its total price, and to correct any errors, before confirming it to express his acceptance. Any order confirmed by the Customer shall constitute a contract of sale and acceptance of all the provisions hereof.

SNB may refuse any order from a Client with whom there is a dispute or an incident relating to the payment of a previous order or which contravenes the provisions hereof.

In this case, SNB will inform the Client by e-mail. Should the Client fail to correct any incorrect information or information contrary to these General Terms and Conditions of Sale with SNB, SNB reserves the right not to process the order.

A confirmation email summarising the order (products, price, quantity, etc.) will be sent to the Client by SNB. To this end, the Client formally accepts the use of electronic mail for the confirmation by SNB of the content of his order. In any event, invoices will be available for downloading in the Client’s client area.

In the event of total or partial unavailability of the products ordered after the order has been placed, the Client will be informed by e-mail of the delivery of a partial order, an extension of the usual delivery times or the cancellation of his order.

In application of the provisions of article L 121-20-3 of the French Consumer Code, in the event of unavailability of the product ordered, the Customer then has the option to cancel the order:

  • Either to be delivered a product of equivalent quality and price, within the limits of available stocks;
  • Or to be reimbursed for the price of the product or service ordered within 30 days of his request.

SNB reserves the right to offer pre-sales on items that are not yet in stock. In this case, the indicative lead times for the availability of items for dispatch are specified in the item sheet.

IV- Prices and Payment Terms

1 – Determination of the price

The prices of the products are indicated in euros, including all taxes but excluding shipping costs. The total price of the order (including all taxes and shipping costs) is indicated on the order summary page which precedes the payment page. 

For deliveries outside French territory, the provisions of the French General Tax Code relating to VAT will be applicable. Customs duties and other taxes applicable in the country of destination of the order must be paid by the Customer directly to the carrier.

The Company SNB reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time the order is recorded, subject to availability.

2 – Method of payment

The products are payable cash on the day of the actual order.

Payment for purchases is made via the secure STRIPE platform using a payment card or a digital wallet (Apple Pay). The payment cards accepted to date are : Carte Bleue, Visa, MasterCard, American express.  In this respect, the Client expressly acknowledges that the communication of his bank card number via the payment platform made available by SNB constitutes authorisation to debit his account up to the total amount of his order. STRIPE is an American company based in San Francisco with an office based in Paris. For all information, the Client may consult the website www.stripe.com.

The Company SNB reserves the right at any time to delete or add new means or propose new payment methods on the Site.

The Client guarantees that he is fully entitled to use the payment card or his digital wallet for the payment of his order. The methods of debiting the Customer’s account are those governed by the banking establishment to which the payment card is attached”.

In certain cases such as VISA or MASTERCARD, the payment platform will require double authentication by 3D Secure with the sending of a code by SMS or an authentication request to be made on the site or application of the banking establishment to which the payment card is attached.

3 – The recorded data
The data recorded and stored by SNB constitute proof of the order and all transactions made. The data recorded by the payment platform constitutes proof of financial transactions.

V- Delivery

Delivery means the physical transfer of the order to the recipient of the order materialized by the physical possession of the Products by the recipient indicated by the Customer when placing the order.  

SNB reserves the right to refuse certain orders from abroad for regulatory reasons or practical difficulties in delivering its products. In this case, it will inform the Client by email within 5 days of the order concerned and will refund the total amount received for this order within 5 days of the email being sent.

Delivery is made to the delivery address indicated by the customer, it being specified that this must be the residential address of the Customer or of any other individual or legal entity of his choice domiciled in France (including DOM-TOM) or abroad. Delivery cannot be made to post office boxes.

The Company SNB entrusts the routing and delivery of orders to partners such as La Poste, Mondial Relay or TNT depending on the delivery option chosen by the Client for his order. However, SNB reserves the right to occasionally use a carrier not specified in this list to ensure delivery of the order under similar conditions and as quickly as possible.

In order for the indicated delivery times to be respected, the Client must ensure that he has provided accurate and complete information concerning the delivery address (such as: street, building, staircase number, access codes, names and/or intercom numbers, etc.) The Client may opt for one of the following delivery methods : 

1 – Standard delivery without obligation with indicative delivery times 

This delivery method is offered (free of charge) by SNB if chosen by the Client. Standard delivery is made by the Post Office or at the collection point: Colissimo or Mondial Relay in France and Delivengo or TNT for international deliveries. The delivery time depends on the destination address of your package or the delivery method chosen. For Metropolitan France, it takes 3 to 5 days from the dispatch of your order for home delivery and 3 days for collection. Any other indicative delivery time can be consulted on the website of La Poste, Mondial Relay or TNT.

The delivery times indicated by SNB for standard delivery are those generally observed. 

2 – Express Delivery with commitment on delivery times

This method of delivery is subject to a charge and is priced according to the country of destination of the order. Express delivery with commitment is carried out by Colissimo de la Poste in France and certain neighbouring countries or TNT Express International for the rest of the world. The delivery time for France is D+1 with delivery before 1:00 pm for an order placed before noon. A new delivery is automatically scheduled for the next working day in the event of the recipient’s absence. For International deliveries, delivery times and details of the zones are available on the carrier’s website or on request from SNB.

3 – Delivery by bicycle courier during the day with a delivery address in Paris or an address eligible for the service in the Paris suburbs. 

This method of delivery is subject to a charge and is priced according to the city of the recipient, i.e. Paris or the city in the Paris region eligible for this option. This option allows delivery between 2pm and 6pm the same day for an order placed before 10am. In the event of the recipient’s absence, no refund can be demanded by the Customer and a new delivery must be scheduled and invoiced.

Late delivery 

SNB cannot be held responsible for the consequences due to a delay in delivery that is not its fault. No reimbursement of postage costs will be made in the event of delivery within a longer period than those indicated, for the absence of the recipient at the time of delivery by the carrier or for failure by the recipient to collect the goods within the time limit by parcel relay. 

In the event that the client does not receive the parcel within 10 working days, the client must alert SNB’s Customer Service department at hello@sanabay.com so that it can carry out additional checks with the carrier.

Impossibility of delivery due to the Client

In the event of impossibility of delivery due to an incorrect address, due to the absence of the recipient at the time of the first delivery and any other passage of the carrier, due to the absence of withdrawal of the order at the collection point selected or at the Post Office in the event of absence at the address provided by the Customer, no reshipment can be required by the Customer. With the agreement of SNB, a reshipment may be scheduled subject to the Client paying new delivery charges before any new dispatch of the order. In the case of a standard delivery, the Client no longer benefits from free transport of the initial order. 

Delivery made 

Each delivery is deemed to have been made as soon as the package is made available to the Customer, in particular by the carrier, materialized by the control system used by the carrier, such as the delivery tracking system proposed on its website or on the delivery notice sent by email or SMS to the Customer. It is the Customer’s responsibility to check shipments on arrival and to make any reservations and claims that appear justified, or even to refuse the package if it is likely to have been opened or if it bears obvious signs of deterioration. The said reservations and complaints must be sent to the carrier by registered letter with acknowledgement of receipt within three working days following delivery of the products, with a copy immediately sent to SNB.

VI- Right of withdrawal and reimbursement

You have a period of 30 days from receipt of our shipment to return, without giving any reason, all products ordered on the www.sanabay.com website. To make a return request, simply log in to your account and follow the online procedure. 

To benefit from your right of retraction, the item must not have been worn or used, nor must it have been personalized. It must be packaged in its original packaging with its protective cover and labels. Shipping costs are at the Customer’s expense and are not refunded.

Refunds for returned products will be made within a maximum of 10 days after receipt of the said products. Refunds are only made on the amount paid by the Customer for the items ordered and do not apply to the shipping costs paid by the Customer at the time of ordering.

VII–Informatics and Freedoms

The information collected by SNB when the Client places an order is necessary for the management of the transaction and for this purpose may be communicated in whole or in part to SNB’s service providers involved in the execution of the order. 

The Client is informed that the same personal data may also be collected by an organisation responsible for analysing orders and combating credit card fraud. 

In accordance with the French Data Protection Act No. 78-17 of 6 January 1978, the Customer has the right to access, rectify, oppose and delete data concerning him/her.

VIII – Hosting provider

The www.sanabay.com website is hosted by OVH, 2 rue Kellermann, BP 80157, 59100 Roubaix.

All SANABAY.com, .fr, .org , as well as all other extensions owned or registered by SNB, and in general all Internet addresses (url) linked to the SANABAY brand and its associated brands are re-routed to the www.sanabay.com website.

The website www.sanabay.com or access to one or more services within the website, in particular the online sales area, may be temporarily or permanently closed without notice or compensation, without any Internet user or Customer being able to claim any compensation whatsoever. In this case, orders registered prior to the closure will be processed according to the above terms and conditions.

IX- Applicable law

Any order automatically implies the Customer’s acceptance of the general terms and conditions of sale. These general terms and conditions of sale are governed by French law. In the event of a dispute, only the French Courts shall have exclusive jurisdiction. In the event of difficulty or complaint in connection with an order, the Customer may contact Customer Service to find an amicable solution. Failing an amicable solution, the dispute will be brought exclusively before the Courts of Bobigny.
